This website is owned and operated by National Association of Sales Professionals (“NASP”) and is part of the Trusum Visions, LLC family of websites and applications. All use of NASP is subject to the terms of this document (the “Terms of Use”). By using this website, by clicking to accept or agree to the Terms of Use, or by becoming a member of NASP, you indicate that you have read, understood, and agree to comply with these Terms of Use and our Privacy Policy, which is incorporated by reference and which shall be considered to be part of these Terms of Use.

As described in more detail below, we agree that you exclusively own your personal information, and we will use the information you supply for the purpose of providing online training focused on sales and professional growth resources throughout our website consistent with applicable federal and state law and regulation, as well as with NASP‘s Privacy Policy.

Our website is designed for educational purposes only. NASP is not responsible for you or your company’s sales success and does not make any claims to be able to fix, grow, resolve or improve any situation. NASP is not designed or intended to replace old fashion hard work and dedication. The information available on NASP should not be used to diagnose or treat any issues with you or your organization.

We retain all copyrights and trademarks within and relating to our website. You may not sell, transfer, reproduce, modify, transmit, distribute, perform or display any portion of our website without our written consent, with the exception of reproduction of materials on a limited basis exclusively for personal use.

NASP reserves the right to change these Terms of Use and its Privacy Policy at any time. We will notify you prior to any substantial change in our Privacy Policies and these Terms of Use. If you do not consent to these changes, it may be possible that a number of features of NASP may not be available for your use.

It may happen that the NASP platform is down, either for planned maintenance or because something goes down with the site. Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas in each case located in Travis County although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Data Usage

For the Growth Quotient (GQ) research study, “Personal Data” means information that identifies or relates to an individual who can be identified directly or indirectly from that data alone or in combination with other information.

You represent and warrant that you have complied with all applicable laws concerning the collection, use, and other processing of Personal Data you provide or makes available to NASP in connection with this Agreement. Without limiting the foregoing: You represent and warrant that you have obtained all necessary consents required to provide or make available Personal Data to NASP in accordance with this Agreement and to authorize NASP to use Personal Data in connection with this Agreement.

NASP may process, retain, use, or disclose the Personal Data as authorized by this Agreement, including for all legitimate business purposes.  You acknowledge and agree that NASP may use aggregated information (that is no longer Personal Data) for NASP’s internal business purposes and in connection with research and reporting to third parties, even if such aggregated information is derived in part from Personal Data, provided that such reporting does not identify you or any individual.  NASP will not process, retain, use, or disclose any Personal Data for any other purpose.

  1. Entire Agreement.

These Terms of Use, and our Privacy Policy, and other policies as posted on the Website from time to time, constitute the sole and entire Agreement between you and the Company with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.

PROGRAM AGREEMENT

This Program Agreement (the “Agreement”) describes the terms and conditions for NASP, a subsidiary of Trusum Visions, LLC – a limited liability company.

THIS PROGRAM AGREEMENT APPLIES TO PURCHASES for any program or service provided by the NASP team.

Your Agreement to Purchase the Program

  1. By clicking the “I accept” button at the end of this Agreement you agree to purchase from NASP any NASP program and/or monthly membership.

What we will do

  1. In return for payment for your NASP program, you will receive access to your program online through your NASP profile passage for the duration of the program. Upon your payment of the fees for the program, you will have access to the program web applications that will provide activities, resources and materials for personal and professional growth.
  2. NASP reserves the right to, and control of, the use of its name, symbols, trademarks and service marks presently existing or later established. You shall not use the NASP’s name, symbols, trademarks or service marks without the prior written consent of NASP, and shall cease any such usage immediately upon request.
  3. Except as expressly set forth in this Agreement, NASP does not warrant that any website or any services provided under this Agreement will meet your requirements or that the operation of the websites prepared by or for NASP will be uninterrupted or error free.
  4. NASP and its affiliates shall have the right to use any data (in a manner that does not identify you) from the services under this Agreement.

What you will do

  1. You will purchase from NASP a membership into one or more of our personal and professional growth programs. You or NASP may terminate your membership in the program at any time however no refunds will be granted. You will complete the on-line enrollment process and pay the current fees for membership in the Program. All sales are final and no refunds will be granted.
  2. You hereby release, waive, discharge and covenant not to sue NASP and its subsidiaries, at any time hereafter, from any and all demands, liabilities, losses, or damages (including death or damage to property) caused or alleged to be caused in whole or in part by the negligence of any of the foregoing people or entities.
  1. Refund Policy

All sales are final and no refunds will be granted.

  1. Assignment

Member may not assign this Agreement to a third party without the express written approval of a duly authorized representative of NASP, and any such attempted assignment shall be void. NASP may assign this Agreement as part of a sale, regardless of whether such a sale occurs through an asset sale, stock sale, merger or other combination, or any other transfer of (i) NASP’s entire business; or (ii) that part of NASP’s business that exercises all rights granted under this Agreement.

  1. Amendment

This Agreement may be amended at any time during the term of the Agreement by mutual consent in writing of duly authorized representatives of the Parties. In addition, NASP may amend this Agreement.

  1. Disclaimer of warranties

Except as expressly provided above, NASP provides the program on an “as is” and “as available” basis without warranties of any kind. NASP expressly disclaims all other warranties, express, implied or statutory, including, but not limited to, the implied warranties of merchantability and non-infringement for a particular purpose and any implied warranties arising out of course of performance or course of dealing. Moreover, NASP makes no warranty of any kind as to the results that may be obtained from use of the program, or as to the accuracy, completeness or reliability of any information or material provided by or through the program.
